The Supreme Court on Monday issued notice to the Centre and the Assam government, seeking a reply within four weeks on a plea that has said that 60 children were in detention centres because their citizenship was yet to be established. In these 60 cases, the plea said, one or both parents had made it to the National Register of Citizens (NRC) for Assam but the children were detained because they could not clear the citizenship test.
The three judge bench headed by Chief Justice SA Bobde agreed to let the children stay with their parents who have been granted citizenship till their case is pending in the NRC tribunals.
The apex court also observed that Solicitor General KK Venogopal has promised that parents who have been included in Assam’s register of citizens but not their children will not be separated for now.
People who had been left out from the final NRC list in Assam were allowed to approach the Foreigners’ Tribunals (FT) within 120 days from the date the list was announced. Over 200 new FTs have been set up across the state for this purpose. Also, if a person is dissatisfied with the FT’s decision, an appeal can be filed.
To accommodate disenfranchised persons, detention camps have been set up across the state. At present, there are six detention centres in Assam's Goalpara, Dibrugarh, Jorhat, Silchar, Kokrajhar and Tezpur, where district jails have been converted to camps.
In the draft NRC, published in 2018, about 40.07 lakh applicants had been left out of the list. The final list, published on 31 August, has been made accessible online and at all NRC seva kendras in the state. (Source; Livemint)
