Why it matters for UPSC
- Linked to GS 3: industrial policy, exports, investment and employment.
- Issues: land acquisition, under-utilisation of notified land, revenue loss and the shift of MAT/DDT benefits.
- WTO export-subsidy concerns have pushed proposals to replace SEZs with broader development hubs (the Baba Kalyani committee recommendation).
Prelims angle
Expect statement questions on the Act, legal status ('foreign territory'), the administering ministry and the difference between SEZs, EPZs and National Investment and Manufacturing Zones.
SEZ versus Domestic Tariff Area: the customs distinction
An SEZ remains part of India. Section 53 of the SEZ Act deems it outside India's customs territory for authorised operations; this does not remove Indian sovereignty or general legal jurisdiction. Domestic Tariff Area (DTA) means India excluding SEZ areas. Under section 30, goods removed from an SEZ to the DTA attract applicable customs duties. Do not assume all services follow the same customs treatment as goods.
For GST, supplies to an SEZ unit or developer for authorised operations are zero-rated, subject to the applicable statutory conditions. Zero-rated is not the same as a blanket exemption for every purchase. Incentives and procedures can change: consult the current Act, Rules and tax notifications rather than memorising outdated tax-holiday claims.
Try a Prelims-style statement question
Consider two statements: (1) An SEZ is outside Indian sovereignty. (2) Goods cleared from an SEZ into the DTA can attract customs duties. Which is correct? A: 1 only; B: 2 only; C: both; D: neither. Answer: B. The customs fiction is limited; section 30 governs DTA clearance of goods.
